Italian Supreme Court, Third Criminal Section, judgment no. 28466/2026, filed on 27 July 2026.
Suspension of construction work does not automatically bring the execution-stage safety coordinator’s duties to an end.
The Supreme Court explained that the coordinator’s responsibilities are not limited to preventing risks arising from interaction between different contractors, but also concern the general safety conditions of the construction site.
Hazards may remain even while work is suspended, for example because of scaffolding, excavations and temporary structures.
It follows that suspension of activities does not in itself release the coordinator from the duties to review and update the safety and coordination plan under Article 92 of Legislative Decree 81/2008.
The judgment is particularly relevant to defining the criminal responsibilities of professionals entrusted with construction-site safety.
