The Sixth Criminal Division addressed the succession of multiple precautionary measures imposed on the same person in separate extradition proceedings concerning different but connected facts.
According to the Court, the backdating mechanism under Article 297(3) of the Code of Criminal Procedure does not apply in this situation. That rule is incompatible with the special regime in Article 714(4), which ties the calculation of custody time limits to each individual extradition request and the related surrender proceedings.
Defence relevance. The ruling limits the application of the so-called chain-measures doctrine in extradition cases and makes it essential, when checking custody time limits, to distinguish each extradition request and its corresponding proceedings.
