Italian Court of Cassation, Sixth Criminal Division, judgment no. 38233, filed on 3 November 2026.
In judgment no. 38233/2026, the Court of Cassation clarified that the aggravating circumstance of trivial motives, under Article 61(1) of the Italian Criminal Code, may apply to the offence of domestic abuse when violent conduct is motivated by a desire to prevent the victim from exercising basic individual freedoms.
According to the Court, the trivial nature of the motive does not concern the severity of the violence but the disproportion between that violence and the reasons prompting it. Seeking to punish the victim for entirely lawful choices — such as using a telephone, leaving the home or making everyday family decisions — reveals the particularly reprehensible nature of the conduct.
The Court also rejected the argument that cultural traditions or religious beliefs can exclude the aggravating circumstance where such beliefs presume the subordination of women in a manner incompatible with the fundamental principles of the legal system.
