Italian Court of Cassation, Fifth Criminal Division, judgment no. 30791, filed on 11 August 2026.
A previous plea-bargaining judgment (patteggiamento) cannot be used to apply the repeat-offender enhancement when the conditions for extinguishment of the offence under Article 445(2) of the Italian Code of Criminal Procedure have been met. That effect arises automatically, without the need for a separate ruling by the enforcement judge.
In the case examined, the defendant’s only previous conviction resulted from a plea-bargaining sentence of one year’s imprisonment. Before the facts underlying the new prosecution, the five-year period following the judgment becoming final had already elapsed without further offences of the same kind.
The Court of Cassation therefore excluded recidivism and remitted the case for reconsideration of the balancing of aggravating and mitigating circumstances and of the sentence.
A comparable consequence for recidivism follows successful completion of supervised probation under Article 47(12) of the Prison Act. As explained by the Joint Criminal Divisions in judgment no. 5859/2012, the resulting extinguishment of the custodial sentence and all other criminal effects prevents the conviction from being relied on for recidivism. In that situation, it is the sentence and its criminal effects that are extinguished, not the offence itself.
The ruling underlines the need to examine the actual legal effects of previous convictions: their continued appearance in criminal records does not by itself justify a recidivism enhancement where the relevant effects have been extinguished.
